How do you get your name off of a home loan?

Let's say that you break up with your girlfriend/boyfriend and you owned a home together for several years. What if your girlfriend/boyfriend doesn't want to allow you to remove your name from the title and the loan for the home? What is the proper way to get out of this arrangement?How do you get your name off of a home loan?
Have fun with this one; if you two can not work out a deal where the one is willing to refinance the note, then only expensive litigation to force the sell of the property is your only recourse



The lender will not release you from the loan, only way is for the other party to refinance, which it seems they do not want to do, or force a sell by the courts, during the process if they stop payment on the loan you will have to make payments until the litigation process is over or your credit will go down the tube

Unfortunately the only way to get out of a mortgage that you are both on is one person would have to refinance the house. So you need a laywer to force her to sell it. Otherwise that house will always show up on your credit as a debt you owe no matter what. Then if she is late or stops paying on the mortgage, it will show up as late on your credit too.




talk to a lawyer. you would have to sign a quit claim deed on the house. you would also have to clear this with the lender. your girlfriend would have to agree to this. it might be easier to either sell the house or for her to refi solo. that is, if she can afford it. if not, there is no legal framework to handle this as you are not married. this is exactly why nonmarried couples should not buy homes. when the breakup comes, it's a royal mess.
Do not sign a quit claim deed. That will just release any rights you have to the house, but will not get you out of responsibility for the mortgage. If the other party will not agree to refinance in their name only, you are going to have to get a lawyer.
Talk to a lawyer. If you purchased the home together, you own half, depnding on how the deed is issued. I wouldn't just walk away and remove your name from the loan and title.
If your ex refuses to refi into her /his name alone...I'm afraid your out of luck.



Maybe a very expensive lawyer you help you out of this mess.
